The following Terms and Conditions govern all supplies of products from "Broker Wholesale Ltd" to the "Customer".

Your acceptance of any product from Broker Wholesale Ltd indicates your acceptance of these terms and conditions.

Payment
Unless a prior agreement has been made with Broker Wholesale Ltd, goods will not be shipped until full payment is received.
a. Goods may be paid for by any of the following means:
(1) Credit Card (Mastercard or VISA Only) (2) Direct Payment into our Bank Account

b. Payment by direct payment will not be considered payment until it has been fully cleared through the banking system into Broker Wholesale Ltd's bank account.

Prices
All prices are set by Broker Wholesale Ltd with the following conditions:

a. Unless otherwise stated all prices quoted are inclusive of Goods and Services Tax (GST), and exclusive of insurance, freight and handling charges.

b. Prices of products may be altered without notice.

c. All backorders at the time of any price change will reflect the new price.

d. Broker Wholesale Ltd reserves the right to refuse to accept any order, or any part of an order, for any reason whatsoever.

Risk, Ownership and Delivery
The customer is responsible for insurance from the time of delivery.

Risk in the goods shall pass to the customer at the time of delivery.

Property and ownership of the goods will remain the property of Broker Wholesale Ltd until payment has been received in full. The purchaser also acknowledges and agrees that a security interest in the goods is given in favour of Broker Wholesale Ltd pursuant to the Personal Property Securities Act 1999.

The customer agrees to pay all delivery costs.

Any quotation of delivery times by Broker Wholesale Ltd are made in good faith, but as estimates and not as commitments.

Broker Wholesale Ltd will not be responsible for non-delivery, delay in delivery or performance, nor for any loss or damage whatsoever caused directly or indirectly by any force majeure. This shall include (but not be limited to) any act of God, natural disaster, flood or earthquake, strike, lockout, fire, war, civil commotion, inability to obtain products or supplies including the imposition of any export or import bans or any other cause beyond our reasonable control.

Warranty
The warranty period varies from product to product.

Any faulty product should be returned to Broker Wholesale Ltd immediately with proof of purchase.

The warranty is void for any goods which have been tampered with, had any warranty labels removed, damaged by accident, improper use or incorrect installation.

Goods found not to have any faults as detailed in any warranty claim will incur a service fee.

Products are subject to the manufacturers warranties only and Broker Wholesale Ltd will pass on the benefit to the customer if it is able.

Any product subject to a warranty claim is to be returned in the same condition it was bought, including manuals and software, or the warranty claim may be rejected.

Returns
Any product returned to Broker Wholesale Ltd for a warranty claim or for any other reason is required to follow these guide lines or any claim will be rejected:
a. The customer will supply the following information:
(1) Full name, address and phone number(2) A copy of the original invoice(3) An accurate and detailed fault description including any error messages and set up configurations

b. Where the goods are subject to a return to base warranty, the customer is responsible for freight charges. The goods will be returned to the customer freight free.
c. All goods must be returned in the original packaging, with disks, manuals etc, and static protection where necessary.

d. The customer must package the goods carefully as Broker Wholesale Ltd will not take responsibility for goods damaged in transit.

e. If Broker Wholesale Ltd agrees to accept the return of goods (other than faulty goods), it may charge a restocking fee. This is levied at Broker Wholesale Ltd's absolute discretion.

Consumers Guarantees Act 1993
In circumstances where Broker Wholesale Ltd is deemed to be a supplier, if the customer acquires the goods for the purpose of business as defined in the Consumers Guarantees Act 1993, the provisions of the Act do not apply. The act is not excluded in any other case.

Privacy Act 1993
The customer authorises any person or company to provide Broker Wholesale Ltd with such information as Broker Wholesale Ltd requires in response to its queries. Broker Wholesale Ltd will not divulge any information to a third party except where necessary due to criminal investigation or similar legal obligation.

The customer shall indemnify Broker Wholesale Ltd against all claims in respect of loss or damage, including loss sustained by a third party howsoever caused after receipt of the goods by the customer.

Errors or Omissions
Clerical errors or omissions, whether in computation or otherwise in any quotation, acknowledgement or invoice, shall be subject to correction by Broker Wholesale Ltd.

Variation
Broker Wholesale Ltd reserves the right to modify and vary these terms and conditions at any time.

Non Waiver
If Broker Wholesale Ltd fails to enforce any terms or to exercise its rights under these terms and conditions at any time, Broker Wholesale Ltd has not waived those rights.

Severability
If any provision of these terms and conditions is held to be invalid or unenforceable for any reason, the remaining provisions shall remain in full force and effect.

Law
These terms and conditions are governed by the laws of New Zealand and any dispute under them shall be subject to the jurisdiction of the Courts of New Zealand.

Information Liability
Broker Wholesale Ltd shall not be liable for any discrepancies between products listed on our website and hyperlinks to manufacturer websites. Broker Wholesale Ltd shall also not be liable for any changes product manufacturers make to their web pages.
